Data Center Sales Tax Exemptions
Most states with significant data-center investment offer targeted sales-and-use tax exemptions for qualifying equipment, electricity, and infrastructure — but qualification is narrow and certificate-driven.
Data-center incentives can be among the most valuable sales tax exemptions
available, but they are also among the most procedural. Pre-certification,
ongoing reporting, and certificate handling at every vendor matter as much
as the underlying statutory entitlement.
What typically qualifies
- Servers, networking, and storage equipment used at a qualifying data center
- Cooling, power conditioning, and backup systems supporting qualifying equipment
- Electricity consumed by exempt equipment (in states that extend the exemption to utilities)
Qualification gates
- Minimum capital-investment thresholds (often tens to hundreds of millions)
- Job-creation or wage-floor commitments
- Pre-certification by the state revenue department or economic-development authority
